Terms and Conditions for NextLevel Systems
1. Use of Resources
Your use of the Company’s website, customer relationship management software, agent portal, leads, or receipt of any commissions or compensation from any insurance carrier affiliated with the Company ("Resources") is conditioned on your acknowledgement, agreement, and compliance with these Terms. These Terms apply to all insurance agents that sell or market any products through affiliation with the Company or in connection with any of the Resources. By using the Company’s Resources, you agree to be bound by these Terms. If you disagree with any part of the Terms, you must notify the Company and discontinue your relationship with the Company immediately. All Resources are provided “as is.” The Company makes no warranties, express or implied, regarding the accuracy, completeness, or performance of any Resource.
2. Outbound Communications and Compliance with Law
In connection with marketing and selling insurance products involving the Company, you agree not to:
Sell leads purchased from the Company without express authorization. Purchase or use leads generated by autodialers, spam texts, or other automated systems. Contact any lead without proper consent or without screening against DNC registries. Contact leads who requested to opt out of communications.Use telephonic or door-to-door solicitation for Medicare products without following specific guidelines.
Violations of any federal or state law, including but not limited to TCPA, TSR, CAN-SPAM Act, HIPAA, CCPA, or Medicare regulations, are prohibited.
3. Communication with Agent
You authorize the Company to contact you regarding insurance products. The Company may use phone, email, text, voicemail, or other methods. You may opt out of communications by notifying the Company.
4. Independent Contractors
Non-employee agents are independent contractors, not employees of the Company. Nothing in these Terms creates a partnership, joint venture, or agency relationship between non-employee contractors and the Company.
5. Trademarks
The Company’s name, logo, and all related names and slogans are trademarks of the Company or its affiliates. You may not use these marks without prior written permission.
6. Indemnification
You agree to indemnify and hold harmless the Company and its affiliates from any claims, damages, or liabilities arising from your violation of these Terms or your use of the Resources.
7. Limitation on Liability
To the extent permitted by law, the Company’s liability is limited to the greater of $1,000 or the amount you paid for access to the Resources. The Company is not liable for any consequential, exemplary, incidental, or punitive damages.
8. Agreement to Arbitrate
All disputes related to these Terms will be settled by binding arbitration in Dallas, Texas, under the AAA Rules. You waive the right to a jury trial or class action. The arbitrator’s award must comply with the Limitation of Liability section.
9. Waiver and Severability
Failure to enforce any provision of these Terms does not constitute a waiver. Any invalid or unenforceable provision will be enforced to the maximum extent possible, and the remaining provisions will remain in effect.
10. Cancellations & Refund Policy:
NextLevel Systems is dedicated to the highest level of customer satisfaction. We offer a no questions asked 30-day refund from any subscription charge. We are unable to refund wallet recharges (phone usage, email usage, premium triggers, etc).
Cancellation Policy: To avoid charges for the next billing period, cancel your subscription at least 24 hours before the billing cycle. Submit cancellation requests via email at [email protected] or through the cancellation form on the website.
Evaluation: Prospective clients are encouraged to use demos, free trials, and consultation services before purchasing to ensure the software meets their needs.
